How MelanMark collects, uses, and protects your information.

This Privacy Policy explains how MelanMark (“MelanMark,” “we,” “us,” or “our”) collects, uses, shares, and protects information when you visit melanmark.com or use our related services (the “Platform”).

The Platform includes the MelanMark Collective, Local & Community, and the Vendor Lounge.

By using the Platform, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

The information we collect depends on how you use MelanMark.

1.1 Information You Provide

We may collect information you provide directly to us, including:

  • Name, email address, phone number, and contact information.
  • Account and profile information.
  • Billing and shipping information.
  • Order and transaction information.
  • Communications with MelanMark, vendors, or other Platform users.
  • Reviews, comments, posts, and other content you submit.
  • Information submitted through forms, surveys, applications, or support requests.
  • Location information you enter, such as a city, ZIP code, or other location.
  • Business information submitted for Local & Community listings.

1.2 Vendor Information

If you apply to or participate in the Collective as a vendor, we may also collect:

  • Business name and contact information.
  • Business ownership and eligibility information.
  • Information and documentation used to review or verify vendor eligibility.
  • Product, storefront, and inventory information.
  • Stripe Connect account and payout-related information.
  • Tax information where required.
  • Order, refund, chargeback, and fulfillment information.
  • Communications relating to your vendor account or customer orders.

Payment and banking information submitted through Stripe may be collected and processed directly by Stripe. MelanMark does not store full payment card information.

1.3 Vendor Lounge Information

If you use the Vendor Lounge, we may collect information associated with your participation, including:

  • Profile information.
  • Posts and comments.
  • Direct messages and other communications.
  • Community activity and interactions.

Vendor Lounge communications should not be treated as private from MelanMark administrators. Authorized administrators may access content, including direct messages, when reasonably necessary to operate, moderate, secure, troubleshoot, or enforce rules within the Vendor Lounge.

1.4 Information Collected Automatically

When you visit or use the Platform, certain information may be collected automatically, including:

  • IP address.
  • Browser and device information.
  • Operating system.
  • Pages viewed and links clicked.
  • Referring pages or websites.
  • Dates and times of visits.
  • General usage and interaction information.
  • Cookie and similar technology information.

With browser or device permission, we may also receive location information from your browser or device to provide location-based features. You can control location permissions through your browser or device settings.

2. How We Use Information

  • Provide, operate, maintain, and improve the Platform.

  • Process and support Collective orders.
  • Facilitate payments, refunds, and vendor payouts.
  • Review vendor applications and continued eligibility.
  • Operate vendor storefronts.
  • Provide and maintain Local & Community listings.
  • Provide location-based search and discovery features.
  • Operate and moderate the Vendor Lounge.
  • Provide customer and vendor support.
  • Review and assist with unresolved order issues.
  • Communicate about accounts, orders, applications, Platform changes, and services.
  • Detect and prevent fraud, misuse, security threats, and violations of our policies.
  • Analyze Platform traffic, performance, and usage.
  • Maintain business and transaction records.
  • Comply with legal, tax, regulatory, and contractual obligations.
  • Protect the rights, safety, and integrity of MelanMark, our users, vendors, and the Platform.

We may also use information for other purposes disclosed when the information is collected or with your consent where required.

3. How We Share Information

We do not sell personal information to advertisers.

We may share information in the following circumstances.

3.1 Vendors and Shoppers

When you make a purchase through the Collective, information necessary to fulfill and support the order may be shared with the vendor responsible for that order. This may include your name, shipping information, order details, and relevant communications.

Vendors may use shopper information only as necessary to fulfill orders, provide customer service, comply with legal obligations, and otherwise use the information as permitted by applicable law and MelanMark’s vendor requirements.

3.2 Service Providers

We may share information with companies that provide services necessary to operate MelanMark, such as:

  • Payment processing.
  • Website hosting and infrastructure.
  • Email delivery.
  • Analytics.
  • Security and fraud prevention.
  • Shipping and order-related technology.
  • Customer support and other Platform functionality.

These providers may process information on our behalf or under their own applicable terms and privacy policies.

3.3 Stripe

MelanMark uses Stripe for payment processing and Stripe Connect for vendor payment and payout functionality.

Information provided to Stripe is handled according to Stripe’s own terms and privacy practices. MelanMark may receive transaction, account status, payout, verification, and other information from Stripe as necessary to operate the Collective.

3.4 Legal and Safety Reasons

We may disclose information when reasonably necessary to:

  • Comply with applicable law, regulation, legal process, or government request.
  • Enforce our agreements and policies.
  • Detect or prevent fraud, security issues, or illegal activity.
  • Protect MelanMark, our users, vendors, or others from harm.
  • Establish, exercise, or defend legal claims.

3.5 Business Transfers

If MelanMark is involved in a merger, acquisition, financing, reorganization, sale of assets, or similar business transaction, information may be transferred as part of that transaction, subject to applicable law.

4. Analytics, Cookies & Similar Technologies

MelanMark uses cookies and similar technologies to operate the Platform, remember preferences, understand how the Platform is used, and improve performance.

We currently use Google Analytics and Independent Analytics to help us understand website traffic and usage.

These services may collect information such as device information, IP address, pages visited, referral information, and interactions with the Platform according to their respective technologies and privacy practices.

You can control or delete cookies through your browser settings. Blocking certain cookies may affect how some Platform features function.

Some browsers or devices provide privacy signals or “Do Not Track” settings. Because there is not a single universally accepted standard for all such signals, our response may depend on the signal, browser, technology, and applicable legal requirements.

5. Local & Community

Local & Community contains business information intended to help users discover businesses with a physical presence.

Some listing information may be provided by business owners or authorized representatives. Business information intended for public display, such as a business name, location, hours, website, and contact information, may be visible publicly through the Platform.

Requests to claim, update, or remove a listing may require information reasonably necessary to confirm the requester’s authority to act for the business.

6. Data Retention

We retain information for as long as reasonably necessary to provide the Platform, maintain business and transaction records, resolve disputes, enforce agreements, meet legal or regulatory requirements, and protect the Platform.

Retention periods vary depending on the type of information, why it was collected, and applicable legal requirements.

Information may remain in backups or records for a limited period after it is deleted from active systems.

7. Data Security

MelanMark uses reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

No website, transmission method, or electronic storage system can be guaranteed to be completely secure.

You are responsible for maintaining the confidentiality of your account credentials and for promptly notifying MelanMark if you believe your account has been compromised.

8. Your Privacy Choices & Rights

Depending on where you live and applicable law, you may have rights relating to your personal information, including the right to request access, correction, or deletion of certain information.

You may also:

  • Update certain account information through your account where available.
  • Manage browser or device location permissions.
  • Manage cookies through your browser.
  • Unsubscribe from promotional emails using the unsubscribe option included in those messages.

We may need to verify your identity before completing certain privacy requests.

Some information may be retained when required or permitted by law, including transaction, fraud-prevention, tax, accounting, dispute, and legal records.

California residents may have additional rights regarding their personal information under applicable California privacy laws. MelanMark will honor applicable rights and requests as required by law.

9. Children’s Privacy

MelanMark is not intended for children under 13, and we do not knowingly collect personal information directly from children under 13.

Vendor accounts, purchases, business listing claims, and other activities requiring a binding agreement are limited to users who meet the eligibility requirements stated in our Terms & Conditions.

If we learn that personal information from a child under 13 has been collected in violation of applicable law, we will take appropriate steps to delete it.

10. Changes to This Privacy Policy

We may update this Privacy Policy as our Platform, practices, or legal requirements change.

The “Last Updated” date at the top of this page identifies the most recent revision.

When required by law, we will provide additional notice of material changes.
